By accessing, using, purchasing, participating in, or being assessed through this Platform, you acknowledge and agree to all terms on this page.

2. Platform Scope

The Platform includes all questionnaires, assessments, tests, scoring systems, algorithms, reports, dashboards, analytics, outputs, credits, and related services under Career Dynamic.

3. Purpose of Use

Assessments are provided solely for:

  • Assessment.
  • Analysis.
  • Research.
  • Workforce insight.
  • Informational purposes.

They are not:

  • Diagnosis.
  • Clinical, psychological, or medical evaluation.
  • Determination of intelligence, competence, capability, performance, or employability.
  • Professional advice.

All results are guides only.

4. No Scientific Claim or Accuracy Guarantee

No claim is made regarding:

  • Scientific validation.
  • Clinical accuracy.
  • Predictive certainty.
  • Statistical reliability.
  • Proven effectiveness.
  • Precision or objectivity.

All outputs are provided without warranty.

5. Non-Reliance and Decision Responsibility

All decisions, including hiring, job offers, training, evaluation, promotion, selection, deployment, or termination, are made solely at the discretion and risk of the appointing company or user.

The Platform must not be used as the sole basis for any decision.

6. No Liability for Interpretation or Use

No responsibility or liability is accepted for:

  • Misinterpretation.
  • Over-reliance.
  • Misuse.
  • Communication of results.
  • Third-party reinterpretation.

7. Scoring, Methodology, and Intellectual Control

All scoring systems, logic, weighting, benchmarks, classifications, thresholds, and determinations of "right answers" are the exclusive property of Ricsources Sdn. Bhd.

All methodologies may be modified, redefined, or discontinued at any time at sole discretion.

8. No Obligation to Disclose or Explain

There is no obligation to:

  • Disclose scoring formulas.
  • Explain calculations.
  • Provide validation or proof.
  • Justify outcomes.
  • Respond to disputes.

No audit, inspection, or reverse-engineering rights exist.

9. Waiver of Challenge

All users and participants irrevocably waive any right to:

  • Challenge scoring.
  • Dispute outcomes.
  • Claim bias, error, or unfairness.
  • Demand recalculation or reassessment.

All results are accepted as-is.

10. Assigned Access and Non-Transferability

Access and assessment are assigned to one specific individual only.

Sharing, delegation, proxy participation, reuse, distribution, or organizational sharing is strictly prohibited.

Unauthorized use voids results and forfeits credits.

11. Credit-Based Charging

Assessments are charged on a per-assessment, per-person credit basis.

Credits are deemed consumed once access is granted or initiated.

12. No Refund and No Transfer

All credits are:

  • Non-refundable.
  • Non-transferable.
  • Non-exchangeable.

No refunds are issued for non-completion, invalid results, withdrawal, technical issues, or service disruption.

13. Credit Validity and Expiry

Credits are valid for up to one (1) year from purchase or issuance, or such other period as determined by the provider.

Expired credits are forfeited permanently without notice, extension, or compensation.

14. No Guarantee of Operation or Availability

The Platform is provided on an "as-is" and "as-available" basis.

No guarantee is made regarding availability, continuity, performance, uptime, or error-free operation.

15. Suspension and Termination

Operation may be suspended, limited, degraded, or terminated at any time without notice for technical, security, business, regulatory, or other reasons.

No refunds or extensions are owed.

16. Data Ownership and Control

All data, results, reports, and outputs are retained, accessed, reused, disclosed, archived, or deleted solely based on the needs and instructions of the appointing company or the provider.

Participants have no ownership or control over results or retention.

17. Data Collection and Use

Data may be collected and used for:

  • Assessment and reporting.
  • Analytics and improvement.
  • Research and studies.
  • Benchmarking.
  • Business intelligence.
  • Marketing and promotion.
  • Product development.

Data may be identifiable, de-identified, aggregated, or combined.

18. Data Sharing and Public Availability

Data may be shared with employers, third parties, service providers, researchers, government or non-government bodies, NGOs, and business organizations.

Data may become publicly available. All related claims are waived.

19. No Confidentiality Guarantee

Confidentiality is not guaranteed.

Sensitive or proprietary information should not be submitted.

20. Information Security Disclaimer

No guarantee is made regarding security of access, storage, or transmission.

No liability is accepted for breaches, unauthorized access, cyber incidents, or data loss.

21. PDPA Malaysia Statutory Carve-Out

Processing complies with the Personal Data Protection Act 2010 (Malaysia) only to the minimum extent required by law.

Statutory rights apply only where mandatory and only where not conflicting with employment, assessment, research, or business purposes.

Derived data, scores, analytics, benchmarks, and internal notes are excluded.

22. Employment and Assessment Context

Assessments are conducted for employment-related purposes including selection, evaluation, training, promotion, workforce planning, and research.

Participant rights may be restricted where permitted by law.

23. Consent Continuity

Consent applies to all stated purposes and continues regardless of employment outcome, role change, objection, or withdrawal where legally permissible.

Past processing remains valid.

24. Cross-Border Processing

Data may be processed or stored outside Malaysia.

All associated risks are accepted.

25. Eligibility and Age Requirement

Participants must be legally eligible.

For minors, appointing companies confirm lawful authority and consent.

Breaches render results invalid.

26. Identity Verification Disclaimer

No obligation exists to verify identity.

Impersonation or proxy participation voids results and forfeits credits.

27. Third-Party Dependency Disclaimer

The Platform relies on third-party infrastructure and services.

No liability is accepted for third-party failures, outages, or incidents.

28. Force Majeure

No liability arises from events beyond reasonable control, including disasters, war, pandemics, regulatory changes, power failure, or cyber incidents.

Credits may expire during such events.

29. Restricted and Regulatory Use Prohibition

The Platform is not approved for medical, clinical, immigration, licensing, statutory, court, or regulatory use.

Unauthorized use is at the user's sole risk.

30. Automated Processing and No Right to Explanation

Assessments may use automated scoring and logic.

There is no right to explanation, disclosure, human review, or override.

31. Emotional and Psychological Impact Disclaimer

No liability is accepted for stress, anxiety, dissatisfaction, offense, or perceived impact.

32. Entire Agreement

This webpage constitutes the entire agreement and supersedes all prior statements, marketing materials, demonstrations, or communications.

33. No Partnership or Agency

No partnership, joint venture, agency, fiduciary, or advisory relationship is created.

34. Assignment and Transfer

The provider may assign rights freely.

Users and appointing companies may not assign without written consent.

35. Indemnity

Users and appointing companies indemnify and hold harmless the provider from all claims, losses, damages, penalties, or costs arising from use, misuse, decisions, data handling, or third-party claims.

36. Limitation of Liability

To the maximum extent permitted by law:

  • No liability for direct or indirect damages.
  • No liability for employment, reputational, emotional, or business losses.
  • Total liability, if any, is limited to fees paid.

37. Severability

If any provision is invalid, remaining provisions remain enforceable.

38. Survival

Liability, indemnity, data use, intellectual property, waiver, and governing law provisions survive termination.

39. Notices

Notices may be given via platform publication, email, or account notification.

Platform publication constitutes valid notice.

40. Class Action and Collective Claim Waiver

All claims must be brought individually.

Class, collective, or representative actions are waived.

41. Right to Refuse Service and Commercial Discretion

The provider may refuse service, change pricing, modify credit structure, rename, bundle, retire assessments, or terminate access at any time without notice.

42. Governing Law

These Terms are governed by the laws of Malaysia.

43. Final Authority

In all matters relating to interpretation, scoring, data use, enforcement, and Platform operation, the determination of Ricsources Sdn. Bhd. is final, binding, and non-reviewable to the maximum extent permitted by law.
